Court Refuses to Hear ED Case Against Gandhis in National Herald Matter

Legal documents representing the court's decision in the ED case

A Delhi court on Tuesday declined to take cognisance of the Enforcement Directorate’s money-laundering complaint against Sonia Gandhi and Rahul Gandhi in the National Herald case. The Rouse Avenue Court ruled that the Court ED Case Gandhi was not maintainable as it was based on a private complaint and not supported by a scheduled offence registered through an FIR, a mandatory requirement under the PMLA.

In a significant development in the Court ED Case Gandhi, the order effectively questions the legal basis of the agency’s complaint. Reacting to the order, the Congress said the ruling exposed the case as politically motivated and termed it a major setback to what it called a sustained campaign against opposition leaders.
